These Kinetal-wide policies apply to Kinetal websites, applications, software products, experiments, and online services unless a product presents additional terms.

Privacy Policy
1. Scope and who we are
Kinetal is an independent software product and consulting practice. This policy explains how Kinetal handles personal information when you visit or use a Kinetal service, contact us, create an account, or work with us. A product-specific notice controls if it clearly states that it supplements or replaces part of this policy.
2. Information we may collect
Depending on the service, we may process information you choose to provide, such as your name, email address, account details, support messages, project information, files, prompts, or other content submitted to a product. We may also process limited technical and usage data needed to provide, secure, troubleshoot, and improve a service, such as timestamps, feature interactions, device or browser information, approximate location derived from an IP address, and diagnostic logs. Payment providers may process billing information directly; Kinetal generally receives transaction status and limited account details rather than full payment-card data.
3. Landing-page analytics
The Kinetal Landing page currently records only an allowlisted call-to-action name, the page path, and the click timestamp. It does not store an IP address, cookie identifier, user agent, referrer, advertising identifier, or visitor profile for this measurement. Kinetal may add a privacy-conscious analytics provider later; this policy and any required consent controls will be updated before collecting data that requires them.
4. How we use information
We use information to provide and operate services; authenticate users; respond to requests; deliver consulting work; personalize requested functionality; maintain security and prevent abuse; diagnose failures; measure product performance; comply with law; and improve Kinetal products. We do not sell personal information or use it for third-party behavioral advertising.
5. Legal bases
Where data-protection law requires a legal basis, we rely as appropriate on performance of a contract, steps requested before entering a contract, legitimate interests such as securing and improving our services, compliance with legal obligations, or consent. You may withdraw consent at any time without affecting earlier processing.
6. Service providers and disclosures
We may share information with hosting, database, authentication, communications, payment, analytics, AI-model, and professional-service providers that help operate a Kinetal service. They may process information only for the relevant service and under their own contractual and legal obligations. We may also disclose information when reasonably necessary to comply with law, protect people or services, investigate abuse, or support a business reorganization. We do not disclose customer content to unrelated parties for their independent marketing.
7. AI features
Some products may send prompts, files, or derived context to third-party AI providers to perform a feature you request. Product interfaces or documentation may identify the provider or offer additional controls. Do not submit sensitive, confidential, or regulated information unless the product explicitly supports that use and you are authorized to provide it.
8. Retention and security
We retain information only as long as reasonably needed for the purposes above, contractual commitments, dispute handling, security, backups, and legal obligations. Retention periods vary by product and data type. We use reasonable technical and organizational safeguards, but no internet service can guarantee absolute security. Please contact us promptly if you believe a Kinetal service or account has been compromised.
9. International processing
Kinetal and its providers may process information in countries other than your own. Where required, we use legally recognized transfer safeguards or rely on a provider's applicable transfer mechanism.
10. Your choices and rights
Depending on your location, you may have rights to access, correct, delete, restrict, object to, or export personal information, and to complain to a data-protection authority. You may also opt out of optional communications. Send a request to the email below; we may need to verify your identity and may retain information where law permits or requires it.
11. Children
Kinetal services are not directed to children under 13, or a higher minimum age where local law requires it, unless a product explicitly says otherwise and provides appropriate safeguards. Please contact us if you believe a child provided personal information improperly.
12. Changes and contact
We may update this policy as Kinetal products and legal requirements change. Material changes will be highlighted through the relevant service where practical, and the effective date above will be revised. Questions and privacy requests can be sent to kinetal.systems@gmail.com.
Terms of Use
1. Agreement and eligibility
By accessing or using a Kinetal service, you agree to these Terms and any product-specific terms presented with that service. If you use a service for an organization, you confirm that you are authorized to accept these Terms for it. You must be legally able to enter this agreement and meet any minimum age shown for the product.
2. Services and accounts
Kinetal may offer free, paid, beta, experimental, or consulting services. You are responsible for accurate account information, safeguarding credentials, activity under your account, and promptly reporting unauthorized access. We may change, suspend, or discontinue a feature, but will try to provide reasonable notice when a material change affects an active paid service.
3. Acceptable use
You may not use a Kinetal service to break the law; violate another person's rights; distribute malware; bypass security or access controls; interfere with service operation; scrape or overload systems in an abusive way; impersonate others; generate or distribute unlawful harmful content; or test vulnerabilities without written permission. Reasonable use of documented interfaces, interoperability, and good-faith security reporting is welcome.
4. Your content
You retain ownership of content you submit. You grant Kinetal a limited, non-exclusive license to host, copy, process, transmit, and display that content only as needed to operate, secure, support, and improve the service or as you otherwise instruct. You confirm that you have the rights and permissions needed to provide the content. Product-specific settings or agreements may provide stronger confidentiality or different model-training commitments.
5. Kinetal materials
Kinetal and its licensors retain rights in the services, software, designs, documentation, and branding, excluding your content and third-party material. Subject to these Terms, Kinetal gives you a limited, revocable, non-transferable right to use the service for its intended purpose. Open-source components remain governed by their licenses.
6. AI-generated results
AI features can produce inaccurate, incomplete, or similar results for different users. Outputs are provided as assistance, not as legal, medical, financial, safety-critical, or other professional advice. You are responsible for reviewing outputs and for decisions or actions based on them. Kinetal does not claim ownership of your output where applicable law permits, but cannot guarantee that an output is unique or eligible for intellectual-property protection.
7. Fees and consulting work
Prices, billing periods, taxes, renewal, cancellation, and refund terms will be shown with a paid product or agreed in writing. Consulting engagements, custom development, service levels, deliverables, confidentiality, and ownership may be governed by a separate proposal or agreement; that agreement controls if it conflicts with these general Terms.
8. Third-party services
Kinetal products may connect to third-party services. Their terms and privacy practices govern your use of those services, and Kinetal is not responsible for third-party systems outside its reasonable control. You are responsible for maintaining any third-party accounts or permissions needed for an integration.
9. Suspension and termination
You may stop using a service at any time. Kinetal may limit or suspend access when reasonably necessary for security, legal compliance, non-payment, material breach, or protection of other users and systems. Where practical, we will provide notice and an opportunity to resolve the issue. Provisions that by their nature should survive—such as ownership, payment obligations, disclaimers, and liability limits—continue after termination.
10. Disclaimers
To the extent permitted by law, services are provided “as is” and “as available.” Kinetal does not promise uninterrupted or error-free operation, that every result will meet your needs, or that all defects will be corrected. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
11. Limitation of liability
To the extent permitted by law, Kinetal will not be liable for indirect, incidental, special, consequential, or punitive losses, or for lost profits, revenue, data, goodwill, or business opportunity arising from a service. Kinetal's total liability for a claim will not exceed the greater of the amount you paid Kinetal for the affected service during the previous 12 months or USD 100. These limits do not apply where liability cannot legally be limited, including liability for fraud or willful misconduct.
12. Responsibility for claims
If your unlawful use, content, or material breach causes a third-party claim against Kinetal, you agree—where permitted by law—to cover reasonable resulting losses and costs. Kinetal will provide prompt notice and allow reasonable participation in the defense; you may not settle a claim in a way that admits fault by Kinetal without consent.
13. General terms and contact
If a provision is unenforceable, the remaining provisions continue. A delay in enforcing a term is not a waiver. You may not transfer these Terms without consent, while Kinetal may transfer them as part of a reorganization or transfer of the relevant service. Applicable law and dispute venue are determined by mandatory law and, where applicable, the product or consulting agreement.
